Who we are

Tiny Forest Labs is a one-person software studio. We make two products: Attic, a home-documentation app for iOS and Android, and Understory, a desktop writing tool for macOS, Windows, and Linux. These terms apply to both products and to this website.

Agreement

By downloading, installing, or using any Tiny Forest Labs product, you agree to these terms. If you do not agree, please do not use the products. These terms are a binding agreement between you and Tiny Forest Labs.

Our products are intended for users who are at least 18 years old. If you are under 18, you should review these terms with a parent or guardian.

Our products

Purchases and payment

Attic purchases are processed entirely by the Apple App Store and Google Play. Your payment details, billing, and refund rights are governed by Apple’s and Google’s terms and policies. We do not handle your payment information for Attic.

Understory is currently free during alpha. When it moves to a paid release, the one-time purchase ($29.99) will be sold through Paddle, our merchant of record, who handles the transaction, sales tax or VAT, and your payment details. Full purchase details will be posted here at release.

We reserve the right to change pricing at any time. Where we have the ability to do so, we will provide reasonable notice of any price changes.

Attic Share subscription

The Attic Share subscription is processed through the App Store or Google Play and renews automatically at the end of each billing period until you cancel. You can cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. Billing and refund rights are governed by Apple’s and Google’s policies.

Refunds

For Attic, all refund requests are handled by the App Store or Google Play. We do not process Attic refunds directly. Please see our Refund Policy for more detail.

Intellectual property

Tiny Forest Labs owns all rights in the apps, website, code, designs, trademarks, and other content we create. Using our products does not transfer any ownership to you. You may not copy, reverse engineer, or redistribute our software except as permitted by applicable law.

Your content, including anything you write or document in our apps, belongs to you. We do not claim any ownership over it.

User conduct

You agree to use our products only for lawful purposes. You may not use them to harm others, to distribute malware, to attempt unauthorized access to any system, or in any way that violates applicable law. You may not scrape, copy, or redistribute our software or services for commercial purposes.

Privacy

Your privacy matters to us. Our Privacy Policy explains what data we collect and how we handle it. It is incorporated into these terms by reference.

Disclaimer

THE PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TINY FOREST LABS DOES NOT WARRANT THAT THE PRODUCTS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TINY FOREST LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, OUR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, IN WHICH CASE THEY MAY NOT APPLY TO YOU.

Termination

We reserve the right to suspend or terminate access to our services for any user who violates these terms or applicable law. You may stop using our products at any time.

Changes to these terms

We may update these terms from time to time. When we do, we will update the date at the top of this page. Continued use of our products after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any disputes that proceed in court will be resolved in Hamilton County, Ohio, and both parties consent to that jurisdiction.

Dispute resolution

If you have a dispute with us, please reach out first. We will do our best to resolve things informally. If informal resolution fails, disputes will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, conducted in Hamilton, Ohio. Both parties waive the right to a jury trial and to participate in a class action. Claims for injunctive relief or enforcement of intellectual property rights are exempt from this arbitration requirement.

Any claim must be brought within one year of when the cause of action arose.

California residents

Miscellaneous

These terms, together with our Privacy Policy and Refund Policy, form the entire agreement between you and Tiny Forest Labs. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
